1. Introduction and Definitions
Welcome to Requesta! By accessing or using the Requesta mobile applications or services provided by Requesta Mobile Services (Pty) Ltd ("Requesta", "we", "our", or "us"), you agree to be bound by these Terms and Conditions.
In this document:
- "Clients" refers to individuals using the Requesta Client App to find services.
- "Service Providers" refers to users offering services via the Requesta Service Provider App.
- "Tokens" Requesta Token:
“Requesta Prepaid Service Token" or "Utility Token" or "Digital Service Credit", means a non-monetary, non-refundable digital unit purchased by the user for the sole purpose of requesting services within the Requesta platform to cover expenses of the platform. It is not redeemable for cash and carries no value outside of Requesta's service ecosystem.
2. Access and Eligibility
2.1 The Requesta Client App is available for download and use by any individual meeting the following criteria:
- Has reached the age of majority in their jurisdiction
- Possesses the legal capacity to enter into binding agreements
- Is not prohibited from receiving services under applicable laws
2.2 Requesta expressly prohibits access or use by:
- Individuals below the legal age of consent in their jurisdiction
- Persons whose accounts have been previously terminated for violations
- Entities or individuals on restricted persons lists
By accessing or using the Requesta platform, you represent and warrant that you meet all eligibility requirements.
3. Service Provider Registration
3.1 Any user wishing to offer services through the Requesta platform must:
- First complete registration as a Client
- Submit a separate application for Service Provider status
- Undergo verification procedures as outlined herein
3.2 Service Provider applicants must provide:
- Valid proof of identity (government-issued identification)
- Evidence of professional qualifications, licenses, or certifications where applicable
- Proof of industry participation (business registration, professional memberships, etc.)
- Any other documentation reasonably required to verify service offerings
Verification Disclaimer: Requesta's verification of Service Providers is limited to confirming the existence of documentation. Requesta does not guarantee the quality, safety, or legality of services provided and makes no representations regarding provider competency.
4. Platform Integrity and Enforcement
4.1 Requesta maintains absolute discretion to suspend or terminate accounts for violations including but not limited to:
- Fraudulent activity or misrepresentation
- Criminal conduct or unlawful behavior
- Violation of these Terms and Conditions
- Actions detrimental to the Requesta platform or its users
- Abusive, harassing, or discriminatory conduct
4.2 Cross-Platform Suspension: Suspension from either Client or Service Provider functionality results in immediate suspension of all platform access. This includes:
- Termination of active service requests
- Revocation of pending appointments
- Restriction from creating new accounts
4.3 Token Forfeiture: Upon account suspension or termination:
- All tokens in the user's account are immediately forfeited
- No refunds or transfers will be processed
- Forfeited tokens become the property of Requesta
- Outstanding token balances are extinguished
These enforcement measures are implemented to protect platform integrity and user safety. Requesta reserves the right to report unlawful conduct to appropriate authorities.
5. User Responsibilities
5.1 Service Provider Obligations:
As a verified Service Provider, you covenant to:
- Maintain current and accurate profile information
- Respond to service requests in a timely manner
- Comply with all applicable laws, regulations, and industry standards
- Obtain and maintain necessary insurance coverage
- Resolve disputes professionally and in good faith
- Provide services with reasonable skill and care
5.2 Client Obligations:
As a Client, you agree to:
- Provide accurate service requirements and specifications
- Communicate clearly and professionally with Service Providers
- Fulfill payment obligations as mutually agreed
- Provide truthful and constructive feedback
- Respect Service Providers' time and expertise
- Ensure safe and appropriate conditions for service provision
6. Dispute Resolution
6.1 Requesta functions solely as a platform for connecting Clients and Service Providers and is not a party to any service agreements between users.
6.2 Platform Role:
- Requesta does not act as a mediator in disputes between users. However, where legally required—such as by a court order or formal arbitration process—we may provide relevant records or evidence in our possession, in accordance with applicable laws and privacy regulations.
- Accounts may be suspended pending dispute resolution
- Fraudulent or defamatory reviews will be removed
6.3 Legal Recourse: For unresolved disputes, users should pursue resolution through:
- Formal mediation or arbitration
- Appropriate legal channels in the relevant jurisdiction
- Industry-specific regulatory bodies where applicable
Disclaimer: Requesta assumes no liability for disputes between users or for the outcome of any dispute resolution process.
7. General Provisions
7.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.
7.2 Amendments: Requesta reserves the right to modify these Terms at any time. Continued use after changes constitutes acceptance.
7.3 Severability: If any provision is found invalid, the remainder shall remain in full force.
7.4 Entire Agreement: These Terms constitute the entire agreement between users and Requesta.
